Dirio Power has welcomed the National Court decision in its favour on 7 July, bringing to an end legal proceedings over PNG Power’s failure to meet its payment obligations under the companies’ Power Purchase Agreement (PPA).
The judgment confirms Dirio Power’s long-held position that the contractual obligations entered with PNG Power must be honoured.
Despite prolonged non-payment, Dirio Power continued generating and supplying electricity, ensuring Papua New Guineans were not disadvantaged while the matter was before the courts.
Chief Executive Officer James Nelson said the decision was an important result for contractual certainty and the future of Papua New Guinea’s energy sector.
“Dirio is grateful to the National Courts for their time and focus in resolving the matter of the unpaid bills. Dirio has always maintained that the PPA with PNG Power reflected a long-term partnership. We trust the decision today renews the sense of partnership between our companies, and we can continue to provide affordable, reliable, and sustainable electricity for a brighter future for all Papua New Guineans.”
Chairman Isaac Lupari said today’s ruling provides the certainty needed for Dirio to move beyond the dispute and refocus on delivering for Papua New Guinea.
“We thank the National Court for upholding the rule of law and recognising the contractual obligations that underpin investor confidence in Papua New Guinea. While this matter should never have reached the courts, today’s decision allows Dirio to focus on the future, continue delivering affordable and reliable power to Papua New Guineans, and pursue new investment that will strengthen our nation’s energy security.”
Dirio Power now looks forward to PNG Power complying with the court’s decision and restoring a constructive working relationship focused on delivering reliable electricity for the people of Papua New Guinea.
